1. Acceptance of the Terms

These Terms and Conditions (“Terms”) govern access to and use of the Fox Cards mobile application (“App”), developed and operated by:

By downloading, installing or using the App, you declare that you have read, understood and fully accepted these Terms and our Privacy Policy (reachable in the App from Settings > Info and legal and at https://nicastro.in/legale/fox-cards-privacy-policy/). If you do not accept the Terms, do not install or use the App.

The App is distributed through the Google Play Store: downloading and installing it are also subject to the Google Play Terms of Service (play.google.com/about/play-terms). In case of conflict between these Terms and Google Play’s, the latter prevail as regards distribution and in-app payments.

No account. The App has no registration or sign-in: there is no “Fox Cards account”. You accept these Terms by installing and using the App.

2. Description of the Service

Fox Cards is a flashcard application for studying that lets you:

• create decks of cards with a front and a back, organise them in folders and attach photos and PDF files to cards;
• choose for each card how to answer: by flipping the card and rating yourself, with a multiple-choice quiz or by typing the answer;
• review with a spaced-repetition algorithm (FSRS) that works out, on the device, when to show each card again;
• view study statistics (streak of consecutive days, charts, activity calendar) and set a daily goal with reminders;
• customise the look with colour themes, some free and some paid;
• download ready-made decks from the in-app Shop, some free and some paid.

Decks, cards, attachments and progress reside on the user’s device. The App has no account, no backend holding user data, no sync and no cloud backup of its own: the Developer has no access, at any time, to the content entered in the App. The only case in which this data may leave the device is Android’s system auto-backup, run by Google and able to be turned off by the user (see the Privacy Policy, section 4.5).

The Service is free. Optional in-app purchases are available (section 4). Until you make a purchase, the App shows a full-screen ad at the start of a study session, at most twice a day; any purchase permanently removes advertising (downloading a free deck is not a purchase and does not remove it). The Shop always requires an Internet connection; for use without a connection, section 2.1 applies.

2.1 Use without an Internet connection

Until you make a purchase, the App is supported by advertising, which can only be served with an active Internet connection. For this reason, if you have never made a purchase and the device stays without a connection for 30 consecutive seconds, the App shows a full-screen notice (“No internet connection”) that suspends its use — studying, the library and statistics included — until the connection is restored. The notice offers a link to the device’s network settings and disappears automatically as soon as the network is available again. No data is lost: decks, cards and progress remain saved on the device.

After any purchase (a theme, a paid deck or ad removal) this limitation no longer applies and studying, the library and statistics also work without a connection. Downloading a free deck is not a purchase and does not remove it.

3. Access Requirements

3.1 Minimum age

To use the App you must be at least 13 years old. In European Union countries the age threshold for independent digital consent varies between 13 and 16 depending on the country (in Italy it is 14, under Legislative Decree 101/2018; in South Korea it is 14, under the PIPA; in China it is 14, under the PIPL): below the threshold applicable in your country, authorisation from a parent or legal guardian is required. In-app purchases by a minor require the authorisation of the person with parental responsibility.

3.2 Supported devices

The App is available for Android devices through the Google Play Store. It is the user’s responsibility to have a compatible device and an Internet connection for the features that need it (Shop, purchases, advertising) and, until they have made a purchase, for using the App in general (section 2.1).

3.3 No registration

The Service does not require creating an account or entering credentials. There is no authentication procedure.

4. In-app Purchases and Payments

4.1 Nature of the purchases

All Fox Cards in-app purchases are one-time purchases (not subscriptions): a single payment, with no renewals or recurring charges. The following are available:

Any purchase, of any kind, also permanently removes advertising.

Some Shop decks are free: they are downloaded without any payment and without going through Google Play, they are not purchases and do not remove advertising. Otherwise the same rules apply as for paid decks (sections 7.3 and 7.4).

Purchases are handled through Google Play Billing and, on the App side, through RevenueCat, Inc., with an anonymous user identifier not linked to any account (see the Privacy Policy, section 4.2).

4.2 Price and billing

The price of each purchase is shown in the App before confirmation and may vary by country and local currency. The amount is charged to the user’s Google Play account at the time of purchase. Since there is no renewal, there are no further charges after the payment.

4.3 Restoring purchases

Purchases are linked to your Google Play account. If you reinstall the App, change device or clear the App’s data, you can restore them without paying again through the “Restore purchases” function in the App (on the colour themes screen), as long as you use the same Google Play account with which they were made. A Shop deck you have already bought can be downloaded again from the Shop, at no extra cost, for as long as it remains in the catalogue (section 7.4). A free deck is not linked to your Google Play account and is not covered by “Restore purchases”: you download it again from the Shop for as long as it remains in the catalogue.

4.4 Refunds

Refunds of in-app purchases are handled by Google Play under its refund policy. To request a refund, follow Google’s official procedure: support.google.com/googleplay. The right of withdrawal (section 5) and the legal guarantee of conformity (section 6) remain unaffected.

4.5 Price changes

We reserve the right to change the prices of in-app purchases. Any change applies only to purchases made afterwards and has no effect on purchases already completed, which remain valid permanently.

5. Right of Withdrawal

5.1 Scope

Under the Italian Consumer Code (Legislative Decree 206/2005, arts. 52 et seq.) and European Directive 2011/83/EU, consumers resident in the European Union and the European Economic Area have the right to withdraw from a distance contract within 14 days, without giving any reason. Consumers resident in the United Kingdom enjoy an equivalent right under the Consumer Contracts Regulations 2013 (UK).

5.2 Immediate performance and right of withdrawal

In-app purchases are digital content not supplied on a tangible medium, performed immediately: the theme unlocks, the deck downloads and advertising disappears as soon as the purchase is completed.

Under art. 59(1)(o) of the Italian Consumer Code (and art. 16(m) of Directive 2011/83/EU), the right of withdrawal lapses before the 14 days only if the consumer has expressly agreed that performance may begin during the withdrawal period and has acknowledged losing the right of withdrawal as a result. The App does not collect that express and separate agreement at the time of purchase: therefore, regardless of anything stated in the Google Play purchase flow, the right of withdrawal under section 5.1 remains exercisable against the Developer within 14 days in the manner set out in section 5.3, even if the purchased content has already been made available.

5.3 How to withdraw

To exercise the right of withdrawal, send a message within 14 days of the purchase to saranicastro.sn@gmail.com with the subject “Fox Cards purchase withdrawal”, stating which purchase it concerns. The refund is processed through Google Play under section 4.4; if the Google Play procedure is no longer available for that purchase, the Developer will refund you by another means agreed with you. After withdrawal, the purchased content (theme, deck or ad removal) may no longer be available in the App.

6. Legal Guarantee of Conformity of Digital Services

Under Legislative Decree 173/2021 (implementing EU Directive 2019/770) and the Consumer Code, consumers are entitled to a digital Service and purchased content that conform to what is described in these Terms and in the App.

In case of non-conformity (for example a purchase that does not activate or a deck that does not download as described), you have the right to request, in order:

1. bringing the Service into conformity (fixing the defect), free of charge and within a reasonable time;
2. a proportionate price reduction or termination of the contract, where bringing it into conformity is not possible or does not happen within a reasonable time.

To report a non-conformity, contact us at saranicastro.sn@gmail.com. These guarantees apply regardless of any other limitation in these Terms and cannot be excluded by contract.

7. Content

7.1 Your content

All content you create in the App — including decks, folders, card texts and attachments — remains your exclusive property. The Developer claims no rights over your content and, since it is stored exclusively on your device, has no access to it and does not use it for any purpose.

You are solely responsible for the content you enter. You declare that you have the right to use the texts, photos and PDFs you attach (for example, that you are not uploading copyrighted material in breach of the rights holders’ rights) and that you do not use the App in breach of applicable laws or third-party rights.

7.2 Data loss

Data resides on your device. The Developer is not liable for data loss resulting from uninstalling the App, clearing the App’s data, device malfunction or replacement, or any other event beyond its control. Android auto-backup, if active, may allow part of the data to be restored on a new device (see the Privacy Policy, section 4.5: for example, attachments are not included in the cloud backup), but it is not guaranteed and is not run by the Developer.

7.3 Shop decks

The decks offered in the Shop, including texts and images, are owned by the Developer or by their respective authors and licensors, shown on the deck’s page. Buying a deck, or downloading a free deck, grants you a personal, non-exclusive and non-transferable licence to use it in the App for personal study. After download the deck is a copy in your library: you may edit its cards, add or delete cards, but you may not redistribute, resell or publish it, in whole or in part, outside the App.

Decks are prepared with care, but they are study support material: they may contain errors, inaccuracies or outdated information and do not replace official texts, teachers or authoritative sources. The Developer does not guarantee that you will pass any exam or certification.

7.4 Availability and updates of Shop decks

The Shop catalogue may change over time: new decks may be added and some may be withdrawn. A deck you have already downloaded stays in your library and keeps working even if it is withdrawn from the catalogue; in that case, however, it can no longer be downloaded again.

The Developer may publish updated versions of a deck (for example to fix errors). The App lets you know when an update is available and, before applying it, shows you which cards change, which are removed and which are new. Updating is always optional, requires no payment and keeps the study progress of the cards that remain; changes you made by hand to the original deck’s cards are replaced by the new version and original cards you had deleted come back into the deck, while cards you added yourself stay untouched.

7.5 Colour themes

Paid colour themes are graphic elements of the App: the purchase allows you to use them in the App, without transferring any rights over the related graphic elements.

8. Developer’s Intellectual Property

The App, its source code, design, themes, logos, the name “Fox Cards”, the Shop decks (section 7.3) and all other elements of the Service are the exclusive property of the Developer or of their respective licensors and are protected by applicable copyright and intellectual property laws.

No provision of these Terms transfers to the user any intellectual property rights in the Service. Using the App grants you only a personal, non-exclusive, non-transferable and revocable licence to use the Service for personal, non-commercial purposes, within the limits set by these Terms.

You may not:

• copy, modify, distribute, sell or sublicense the App or parts of it, including Shop decks;
• decompile, reverse engineer or attempt to extract the App’s source code;
• remove or alter any copyright or trademark notice in the App;
• circumvent, disable or alter the App’s advertising, payment or verification mechanisms (including attempting to obtain themes, decks or ad removal without the related purchase, or to download Shop decks outside the App);
• use automated tools (bots, scrapers, etc.) to interact with the App or the Shop;
• use the App for commercial purposes without the Developer’s written authorisation.

9. Prohibited Conduct

By using the App, you agree not to:

• use the Service for illegal purposes or in breach of applicable laws;
• interfere with the operation of the App or of the third-party services it uses;
• upload or transmit viruses, malware or any other harmful code;
• use the App to infringe intellectual property, confidentiality or other third-party rights.

10. Review Algorithm and Statistics

The App suggests the cards to review using the FSRS algorithm, run entirely on the device from the ratings you give. The algorithm, the daily goal, reminders and statistics are tools to support the organisation of your study: the Developer does not guarantee any learning, memorisation or exam results. Reminders depend on the device settings (notification permission, battery saving) and may not be delivered in every circumstance.

11. Service Availability and Changes

11.1 Availability

We strive to keep the Service available, but cannot ensure uninterrupted or error-free operation. Some features depend on third-party services (Google Play, Firebase, AdMob, RevenueCat) beyond our control; the Shop may be temporarily unreachable.

11.2 Changes to the Service

We reserve the right to modify or update the App over time, including by adding, changing or removing features. Changes that significantly reduce the features of the App or of purchased content will be communicated to you with at least 30 days’ notice through a notice in the App and/or on the App’s Google Play listing.

11.3 Permanent discontinuation of the Service

If the Service is permanently discontinued, we will give you at least 30 days’ notice (where possible), through a notice in the App and/or on the App’s Google Play listing and, if the App is no longer available on the Play Store, through a notice published on https://nicastro.in. Local data, including decks already downloaded, stays on your device until you uninstall the App or clear its data; the Shop and deck downloads may no longer be available.

Any refund requests following the discontinuation follow Google Play’s refund policy. A purchase completed long before the discontinuation does not in itself give the right to a refund, without prejudice to any proportionate refund due under consumer protection law.

11.4 Support period and updates

The App is offered without any guaranteed minimum period of support or updates. The Developer does not undertake to release updates, fixes or new features for a set duration and may stop developing and maintaining the App at any time, subject to the notice set out in section 11.3.

Nonetheless, for purchased content (section 4), the Developer provides the updates — including security updates — needed to keep it in conformity for the period the consumer can reasonably expect given its nature and one-time price, under Legislative Decree 173/2021. This obligation does not entail adding new features or unlimited support over time.

Failing to update the App for new versions of the Android operating system, changes to third-party services (Google Play, Firebase, AdMob, RevenueCat) or new device models may make it partly or wholly unusable: in that case section 11.3 applies.

12. Limitation of Liability

To the extent permitted by applicable law and without prejudice to section 6 (Legal Guarantee of Conformity):

1. Exclusion of additional warranties: beyond the mandatory legal guarantee of conformity, the Service is provided “as is”, without further express or implied warranties.

2. Limitation of damages: the Developer will not be liable for indirect, incidental, special, consequential or punitive damages arising from the use of or inability to use the Service, including — without limitation — data loss, the outcome of exams or tests, loss of profit or business interruption.

3. Liability cap: the Developer’s total liability to the user for any claim arising from these Terms does not exceed the amount paid by the user for the Service in the last 12 months, or 10 euros if the user has made no payment.

The above limitations do not apply in case of wilful misconduct or gross negligence by the Developer, death or personal injury caused by negligence, or any other case in which applicable law does not allow such exclusions. Consumers’ mandatory rights under Italian and European law remain unaffected in any case.

13. Ending Use

Since there is no account, you can stop using the Service at any time simply by uninstalling the App. Uninstalling or clearing the App’s data (Android Settings > Apps > Fox Cards > Storage > Clear data) irreversibly deletes all local data, as described in the Privacy Policy. Any copies created by Android auto-backup remain subject to Google’s settings and retention periods and must be deleted separately (see the Privacy Policy, section 4.5).

When use ends for any reason, the licence to use the App granted under these Terms ends immediately. Provisions of these Terms that by their nature must survive termination (including the sections on intellectual property, limitation of liability and jurisdiction) remain in force. Purchases already made stay linked to your Google Play account and can be restored on a future reinstall (section 4.3).

14. Changes to the Terms

We reserve the right to update these Terms at any time. The current version is always available in the App (Settings > Info and legal) and at https://nicastro.in/legale/fox-cards-terms-and-conditions/.

For material changes — those affecting users’ rights or economic conditions — we will give at least 30 days’ notice through a notice in the App and/or on the App’s Google Play listing, clearly stating what changes. On the first launch after a material change to these Terms or to the Privacy Policy, the App may show a one-time notice inviting you to read them.

For non-material changes (editorial corrections, link updates, mandatory regulatory adjustments), continued use of the App after the effective date constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by Italian law, in compliance with applicable European rules, including the Consumer Code (Legislative Decree 206/2005) and Legislative Decree 173/2021.

For any dispute concerning these Terms or the use of the Service, the Court of Trieste (Italy) has exclusive jurisdiction, subject to any mandatory provision of law applicable in the user’s country of residence.

Consumers resident in any country retain in any case the rights granted to them by the mandatory law of their country of residence, regardless of the governing law stated in these Terms. Consumers resident in the European Union may also use the alternative dispute resolution (ADR) bodies provided for by Directive 2013/11/EU — in Italy, the ADR bodies listed in the registers kept by the competent authorities under arts. 141 et seq. of the Consumer Code.

16. General Provisions

• Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between the user and the Developer regarding the Service and supersede any prior agreement.
• Severability: if a provision of these Terms is held invalid or unenforceable — including under consumer protection law — the remaining provisions remain fully in force.
• Waiver: failure to exercise a right under these Terms does not constitute a waiver of that right.
• Assignment: you may not assign your rights or obligations under these Terms without the Developer’s prior written consent. The Developer may assign its rights and obligations without restriction, provided this does not prejudice the user’s rights.
• Force majeure: the Developer is not liable for delays or failures caused by events beyond its reasonable control.
• Prevailing language: these Terms are available in Italian and English. In case of conflict or inconsistency between the versions, the Italian version prevails.
